Business Terms and Conditions of Leader Fox

These Business Terms and Conditions apply to purchases made through the Leader Fox a Dirtparade online store (as the Seller) run by BOHEMIA BIKE a.s. The Terms and Conditions define and specify the rights and obligations of the Seller and the Seller’s customers (the Buyers). 

 

Raising the Order and entering into the Purchase Agreement

  1. Sale of the order confirms that the Buyer has read and understood and agreed with the Claims Procedure and these Business Terms and Conditions.
  2. The order represents an offer of the Purchase Agreement. The Purchase Agreement comes into effect upon reception of the ordered goods by the Buyer.
  3. The electronic order may not become valid unless all data and requisite information required in the form has been provided appropriately.
  4. The place of delivery is the delivery address provided by the Buyer in the order form.
  5. The ownership right to the goods passes to the Buyer upon payment and reception of the goods by the Buyer.
  6. By filling in the registration form or the order within the Leader Fox a Dirtparade online store, the Buyer agrees that the Seller is allowed to collect and archive the Buyer’s personal information and data related to purchases performed by the Buyer.
  7. According to 367/2000 Par. 6 Civil Code as amended, the Buyer is entitled to withdraw from the Agreement within 14 days after taking over the goods. In such case, the Buyer must send the goods within the said time frame (the date of shipment being the decisive date) back to the address of the store’s premises. The goods must not be damaged and must not bear any marks of wear or tear and must be sent in its original packaging along with all relevant documents (user guides, warranty certificates etc.). The address of the premises is as follows: Bohemia bike a.s., Okružní 697, České Budějovice, 370 04. Upon reception of the goods returned by the Buyer, the Seller shall without delay return to the Buyer the corresponding sum via a method agreed upon in advance. The sum returned shall reflect the difference between the purchase price and the costs incurred by the Seller in delivering the goods to the customer (e.g. transport costs etc.).
  8. Upon having received and checked the returned goods, the Seller shall without delay send a credit note to the Customer. Upon confirmation of the credit note, the Seller shall return the relevant sum via the method agreed upon in advance, within 30 days at the latest.

 

Claims and Warranty

  1. We will settle all claims to your satisfaction upon individual agreement and in compliance with valid legislation. The Buyer is obliged to check the goods for any faults or damage once they take it over. If the Buyer finds any damage, they are obliged to notify our company immediately.
  2. We cannot be held responsible for defects caused by transportation or shipping services.
  3. All goods are covered by a statutory warranty of 24 months.
  4. The warranty only applies to production defects. Defects caused as a result of common wear and tear or improper use cannot be claimed under warranty.
  5. If the Buyer purchases a bicycle only partly assembled to 85%, they are obliged to have it assembled by a professional for a fee. The confirmation provided in the warranty certificate shall serve as a proof of this. Any defects caused in assembling cannot be claimed under warranty if the bicycle has been assembled by a non-professional or by the Buyer.
  6. If you want to raise a claim, you need to inform us via phone, e-mail or in written.
  7. When sending the goods back, send it as a shipment signed for to the address of our company. Along with the shipment, please provide the reason of your claim and your contact information. Include this information in the shipment along with all documents related to the purchase and reception of the claimed goods.

 

Withdrawal from the Purchase Agreement by the Seller and the right of price change

  1. The Seller reserves the right to cancel the order or a part thereof in the following cases:
  2. The goods are no longer being manufactured or supplied
  3. The supplier of the goods has considerably changed the price of the goods
  4. In such cases, the Buyer shall be contacted without delay and further steps shall be agreed upon. If the Buyer has already paid a part of or the whole purchase price, the relevant sum shall be sent back to the Buyer's account or address within the shortest time possible.
  5. The Buyer reserves the right to change prices. Valid prices are confirmed to the Buyer upon confirmation of the order. If the valid price is lower than or matches the price on the order, it shall not be confirmed to the Buyer again and the goods shall be delivered to the Buyer at the price which was valid at the time of reception of the order. If the price exceeds the price stated on the order, the Seller shall immediately notify the Buyer who may accept the new price or refuse the delivery. When ordering by phone, the Buyer is always informed of the valid price for the given order.

 

Final Provisions

  1. The valid version of these Business Terms and Conditions is the version provided on the Seller’s website on the date of submission of the electronic order by the Buyer.
  2. By submitting the electronic order, the Buyer confirms without reservation their acceptance of all provisions of the Business Terms and Conditions as valid on the date of the submission of the order and the price of the ordered goods as valid on the date of the submission of the order (including the transport cost or postage) as stated in the catalogue of the Leader Fox a Dirtparade online store, if not provably agreed otherwise in the given case. Submission of the order (an offer of the Purchase Agreement) binds the Buyer irrevocably.
  3. In situations not covered by these Business Terms and Conditions, the relationship of the Seller and the Buyer shall be governed by valid legal provisions, by the Commercial Code and the Civil Code in particular.
